Terms of Use – Pilgrim Port
1. Agreement Overview
These Terms (“Terms”) constitute a legal agreement between you and Piligrim Delivery Inc. (“Company,” “we,” “us,” or “our”). Pilgrim Port is a brand and service operated by Piligrim Delivery Inc. Any person using the Pilgrim Port website (hereinafter referred to as the “Website”) or related mobile applications (hereinafter referred to as the “Applications”) is considered a “User” and agrees to these Terms, which govern their use of the services provided through the Website and Applications (hereinafter referred to as the “Services”). The Services may be provided on either a paid or free basis.
2. Definitions
Definitions for capitalized terms not defined below can be found in Section Sixteen (16) of these Terms.
3. Description of Services
Pilgrim Port is an online platform operated by Piligrim Delivery Inc. that facilitates connections between Participants (as defined below) regarding goods, products, or other items (hereinafter referred to as the “Parcel”) that a Participant wishes to send and the transportation of such Parcels to a specific location (hereinafter referred to as the “Destination”) within an agreed timeframe (hereinafter referred to as the “Delivery Date”).
A Participant who wishes to send a Parcel to a Destination (hereinafter referred to as the “Sender”) may post a request (hereinafter referred to as the “Request”) on the Website or through the Applications, describing the Parcel, the Destination, the Delivery Date, and, where applicable, the amount they are willing to offer for its delivery. The delivery may be arranged either free of charge or for an agreed amount, as determined by the Participants.
A Participant traveling to or through the Destination (hereinafter referred to as the “Traveling Participant”) may respond to a Request and accept it by agreeing to the Sender’s proposed terms or may communicate with the Sender to negotiate different terms, including whether the delivery will be provided free of charge or for an agreed amount.
Once the Sender and the Traveling Participant agree on the terms of the delivery, including any applicable amount, they may enter into an agreement directly with each other through the general chat or other communication features of the Applications. Any such agreement is solely between the Sender and the Traveling Participant. Piligrim Port is not a party to such agreement and does not act as a carrier, delivery service provider, payment processor, escrow service, or guarantor of either Participant’s obligations.
4. Principles and Obligations of the Parties
Pilgrim Port provides a platform that facilitates communication and connections between Participants and is not a party to any Transaction or agreement between Participants. Pilgrim Port does not sell, purchase, accept, possess, transport, or deliver Parcels and does not act as a carrier or delivery service provider. Each Participant is solely and fully responsible for fulfilling their obligations under any Transaction or agreement they enter into with another Participant.
5. Application of Local and International Laws
You agree that Sections Two (2) through Five (5) of these Terms apply to all Transactions arranged through the Website and Applications and supplement any applicable local, national, or international laws and regulations governing such Transactions. Nothing in these Terms is intended to exclude, limit, or override any applicable law or regulation.
Pilgrim Port is not a party to Transactions between Participants and does not voluntarily intervene in legal disputes between Participants. Participants are solely responsible for resolving any disputes arising from or relating to their Transactions in accordance with these Terms and all applicable laws and regulations.
6,Payments and Fees
Any fees paid to Piligrim Port are separate from and do not constitute payment for the delivery of a Parcel between Participants. Pilgrim Port does not guarantee the performance, completion, or outcome of any Transaction between Participants.
Pilgrim Port does not provide escrow, payment holding, or money transfer services in connection with Transactions between Participants. Pilgrim Port does not receive, hold, or distribute payments or other compensation owed by one Participant to another for the delivery of a Parcel. Any payment or compensation agreed upon between a Sender and a Traveling Participant is made directly between the Participants and is solely their responsibility.
Pilgrim Port may, from time to time, charge Participants fees for certain services or features provided by the platform, including a fee for a successful connection between Participants. Any applicable fees charged by Piligrim Port will be clearly disclosed to the relevant Participant before the fee is incurred.
7. Delivery and Import
The Traveling Participant and the Sending Participant agree to: (a) bear full legal responsibility for ensuring that the Parcel can be legally transported and imported to the destination in compliance with all local legal and tax regulations of the destination country, as well as international regulations, and (b) release Piligrim Delivery from any liability or loss they may incur in the event of violating any import laws, customs, or tax regulations. All Participants acknowledge that Piligrim Delivery is not responsible and is not required to guarantee compliance with all applicable laws during the transaction process.
Parcels sent from any country (place of origin) to a foreign destination may be subject to import taxes, customs duties, and fees levied by government authorities upon arrival at the destination. These taxes and fees may include, but are not limited to, local sales taxes, import duties, as well as possible additional local charges that may vary depending on the jurisdiction and the type of parcel. The Traveling Participant is the importer of record and is responsible for complying with all laws, regulations, and tax obligations of the destination country, including any local legal and tax rules that may differ across countries.
Piligrim Delivery does not control and cannot pre-assess or calculate these fees during or before delivery. Customs and tax policies may vary significantly from country to country, and also depend on the type of parcel, its value, and destination. The Traveling Participant should contact the relevant customs and tax authorities in each destination country for detailed information on applicable fees, taxes, restrictions, and local rules that may affect delivery. Violation of import laws, including failure to comply with local requirements, may result in parcel confiscation and penalties.
The Traveling Participant also agrees to comply with all local legal, tax, and customs requirements of each country, including but not limited to laws prohibiting the import of restricted goods, regulations on declaring the value of the parcel, and other regulations. Piligrim Delivery has no control over local legal requirements or policies that may affect delivery and is not responsible for any delays, confiscations, or penalties arising from failure to comply with these requirements.
8. Delivery and Import
The Traveling Participant and the Sending Participant are solely responsible for ensuring that the Parcel may be legally transported, carried, received, and, where applicable, imported into the Destination in compliance with all applicable local, national, and international laws, regulations, customs requirements, and tax obligations. Each Participant is responsible for obtaining any permits, declarations, licenses, or other documentation that may be required for the Parcel or the Transaction.
The Participants acknowledge that Piligrim Port is not a party to any Transaction between Participants and does not determine whether a Parcel may legally be transported or imported into any particular country or jurisdiction. Piligrim Port does not provide customs, tax, legal, or import advice and does not guarantee that any Parcel, Transaction, or delivery arrangement complies with the laws or regulations of any jurisdiction.
Parcels transported across international borders may be subject to customs duties, import taxes, sales or value-added taxes, customs processing fees, and other charges imposed by governmental authorities. Such charges may vary depending on the country of origin, Destination, type and value of the Parcel, applicable exemptions, and other circumstances. Any such duties, taxes, fees, or charges are the responsibility of the Participant to whom they are legally imposed.
Where applicable under the laws of the Destination country, the Traveling Participant may be required to act as an importer, declare the Parcel to customs authorities, provide information regarding the Parcel and its value, and comply with all applicable import and tax requirements. The Traveling Participant is solely responsible for understanding and complying with such requirements before and during the delivery.
Pilgrim Port does not control, determine, or guarantee the amount of any customs duties, taxes, fees, or other charges imposed by governmental authorities and cannot pre-assess or calculate such amounts on behalf of Participants. Customs and tax requirements may vary significantly between jurisdictions and may change from time to time. Participants should consult the relevant customs, tax, or other governmental authorities before arranging an international delivery.
Participants must not use the Services to transport or deliver Parcels containing goods that are prohibited, restricted, improperly declared, or otherwise unlawful in the country of origin, transit, or Destination. Participants are solely responsible for determining whether a Parcel and its contents are permitted under applicable laws and for complying with all applicable declaration, packaging, labeling, documentation, customs, and import requirements.
Pilgrim Port is not responsible for any delay, refusal of entry, seizure, confiscation, destruction, additional charge, fine, penalty, loss, or other consequence arising from a Participant’s failure to comply with applicable laws, customs requirements, tax obligations, or restrictions. To the extent permitted by applicable law, Participants agree to release and hold Pilgrim Port and Piligrim Delivery Inc. harmless from claims, losses, liabilities, penalties, or expenses arising from such violations or non-compliance.
9. Account Registration
Each Participant may maintain only one active Piligrim Port Account. Piligrim Port may suspend or terminate duplicate accounts and may require Participants to verify or update their account information before accessing certain Services or completing a Transaction.
To use the Piligrim Port Services, you must register as a Participant and create an account (the “Pilgrim Port Account”). You may browse certain portions of the Website or Applications without providing credit card or bank account information. Registration may be completed directly or through a third-party authentication provider, such as Google or Apple. To create a Pilgrim Port Account, you must provide a valid mobile phone number and email address. You must be at least 18 years old to register as a Participant and engage in Transactions through the Services.
You agree to provide accurate, complete, and up-to-date information during registration and to keep such information current. You must not register for or use an account using:
(i) the name, email address, or mobile phone number of another person with the intent to impersonate that person;
(ii) information belonging to another person without their authorization; or
(iii) a name or other account information that is offensive, vulgar, misleading, or otherwise inappropriate.
Pilgrim Port reserves the right to refuse registration, suspend, restrict, or terminate an account, or limit access to the Website, Applications, or Services at its reasonable discretion, including where a Participant violates these Terms, provides inaccurate or misleading information, or creates more than one active account.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activities conducted through your account, whether or not such activities were authorized by you. You must not share your account credentials with any third party. If you become aware of any unauthorized access to or use of your account, or any other security breach, you must promptly notify Pilgrim Port in writing.
10. Termination
Pilgrim Port reserves the right to refuse or suspend access to the Services, or to suspend or terminate a Participant’s Pilgrim Port Account, if the Participant violates these Terms, applicable laws or regulations, or otherwise misuses the Website, Applications, or Services. Where permitted by applicable law, Pilgrim Port may take such action with or without prior notice.
11. User Conduct
You understand and agree that you are solely responsible for complying with all applicable laws, rules, regulations, and tax obligations arising from or relating to your use of the Website, Applications, and Services.
You agree to exercise reasonable care and caution in all communications and interactions with other Participants and users of the Website, Applications, and Services, as well as with any person you meet or interact with as a result of using the Services, including when arranging or attending an in-person meeting. Pilgrim Port does not control or guarantee the identity, conduct, or actions of any Participant.
In connection with your use of the Website, Applications, and Services, you agree that you will not:
(a) violate any applicable local, provincial, state, national, or international law, regulation, or court order, including laws relating to the transportation, possession, import, export, or distribution of prohibited or controlled goods, customs, and taxes;
(b) use any software, device, script, bot, crawler, scraper, or other automated or manual method to access, collect, copy, monitor, or interact with the Website, Applications, Services, or Content in a manner not expressly permitted by these Terms;
(c) use the Website, Applications, or Services for any purpose that is unlawful, fraudulent, abusive, or otherwise prohibited by these Terms, or in a manner that misuses or interferes with the intended operation of the Services;
(d) copy, store, reproduce, distribute, or otherwise use information or Content available through the Website or Applications except as expressly permitted by these Terms;
(e) use the Website, Applications, Services, or Content to infringe, misappropriate, or otherwise violate the intellectual property, privacy, publicity, contractual, or other rights of any person or organization;
(f) interfere with, disrupt, damage, disable, overburden, or otherwise impair the operation or security of the Website, Applications, Services, or related systems, including through viruses, malware, Trojan horses, malicious code, denial-of-service attacks, packet spoofing, falsified routing information, or similar methods;
(g) transmit, distribute, publish, or otherwise disclose personal or confidential information about another person or organization without proper authorization, including photographs, contact information, financial information, payment card information, account credentials, or other sensitive information;
(h) use the Website, Applications, or Services to send unsolicited commercial communications, spam, advertisements, or promotional materials unrelated to Piligrim Port or the relevant Transaction;
(i) stalk, harass, threaten, intimidate, abuse, or otherwise engage in harmful conduct toward another Participant or user, or collect, retain, or misuse personal information about another Participant for improper purposes;
(j) create or maintain more than one active Piligrim Port Account, create an account on behalf of another person without authorization, or use another person’s account;
(k) contact or communicate with another Participant for purposes unrelated to a Transaction, the use of the Website, Applications, or Services, or another legitimate purpose permitted by these Terms;
(l) use the Website, Applications, or Services to recruit, solicit, redirect, or encourage Participants to use third-party services that compete with Piligrim Port, except where such activity is expressly authorized by Piligrim Port;
(m) impersonate any person or organization, or falsely represent your identity, affiliation, authority, or relationship with any person or organization;
(n) use automated scripts, bots, crawlers, spiders, scraping tools, or other automated means to collect information from or interact with the Website, Applications, or Services without Piligrim Port’s prior written authorization;
(o) post, upload, publish, send, or otherwise transmit any Content that:
(i) infringes, misappropriates, or violates any patent, copyright, trademark, trade secret, moral right, privacy right, publicity right, or other intellectual property or proprietary right of any person or organization;
(ii) violates any applicable law or regulation or encourages conduct that could result in civil or criminal liability;
(iii) is false, deceptive, fraudulent, misleading, or materially incomplete;
(iv) is defamatory, obscene, pornographic, vulgar, excessively offensive, or otherwise inappropriate;
(v) promotes discrimination, intolerance, racism, hatred, harassment, or harm against any individual or group;
(vi) is violent, threatening, or intended to promote or encourage violence or harm against another person;
(vii) promotes, facilitates, or encourages illegal or harmful activities, goods, or substances; or
(viii) contains malicious software, code, links, or other material intended to interfere with or compromise the security or operation of any system;
(p) systematically collect, harvest, copy, or compile data or other materials from the Website, Applications, or Services to create or maintain databases, directories, catalogs, datasets, or similar collections, whether manually or through bots, crawlers, spiders, scraping tools, or other means;
(q) use, display, mirror, frame, reproduce, or otherwise incorporate the Website, Applications, Services, or any portion thereof, including the Piligrim Port name, trademarks, logos, Content, layout, or design, without the express written permission of Piligrim Port;
(r) access, interfere with, or use restricted or non-public areas of the Website, Applications, Piligrim Port’s systems, or the technical systems of its service providers;
(s) probe, scan, test, or attempt to identify vulnerabilities in any Piligrim Port system, network, or security mechanism, or attempt to bypass authentication or other security measures;
(t) circumvent, disable, remove, impair, decode, or otherwise bypass any technological or security measures implemented by Piligrim Port, its service providers, or other authorized third parties to protect the Website, Applications, Services, or Content;
(u) falsify, manipulate, or conceal the source of any communication, transmission, message, posting, or other information submitted through the Website, Applications, or Services, including by spoofing technical headers or other identifying information;
(v) attempt to decrypt, decompile, disassemble, reverse engineer, or otherwise derive the source code or underlying structure of any software used to provide the Website, Applications, Services, or Content, except to the extent expressly permitted by applicable law; or
(w) encourage, assist, facilitate, or knowingly permit any third party to engage in any of the activities prohibited by this Section.
12. General Disclaimers and Disclaimer of Warranties
NO INFORMATION OR ADVICE OBTAINED THROUGH THE WEBSITE, APPLICATIONS, SERVICES, OR FROM PILIGRIM PORT SHALL CREATE ANY WARRANTY OR REPRESENTATION NOT EXPRESSLY SET FORTH IN THESE TERMS.
If you choose to use the Website, Applications, and Services, you do so at your own risk. You acknowledge and agree that Piligrim Port is not obligated to verify the identity, information, statements, or other data provided by Participants, although Piligrim Port may verify such information at its discretion and where permitted by applicable law.
Any advice, information, or Content provided by Pilgrim Port, displayed on the Website, or transmitted through the Website, Applications, or Services is provided for general informational purposes only and does not create any warranty, representation, or guarantee unless expressly stated in these Terms.
You are solely responsible for your communications, interactions, meetings, and Transactions with other Participants. You understand that Pilgrim Port does not routinely verify the accuracy, completeness, reliability, or truthfulness of statements, profiles, Requests, Trips, or other Content submitted or posted by Participants.
Pilgrim Port does not represent or guarantee that any Participant is trustworthy, qualified, suitable, available, or capable of completing a Transaction or delivering a Parcel. You are solely responsible for evaluating another Participant and determining whether to enter into a Transaction with that Participant.
Pilgrim Port does not guarantee that the Website, Applications, or Services will be compatible with your intended use, or that the use of the Services by other Participants will meet your expectations or requirements.
(a) Lost, Damaged, or Stolen Property. To the maximum extent permitted by applicable law, Participants release Pilgrim Port and Piligrim Delivery Inc. from claims, liabilities, losses, damages, costs, or expenses arising from or relating to the loss, theft, destruction, misplacement, delay, or damage of any Parcel or other property in connection with a Transaction, including where such loss or damage results from delivery issues, the acts or omissions of another Participant, dishonest or fraudulent conduct, or any other circumstance relating to a Transaction.
Pilgrim Port is not a carrier, delivery service provider, custodian, or insurer of Parcels and does not take possession, custody, or control of Parcels transported through the Services.
(b) Taxes, Import and Export Duties. Participants are solely responsible for complying with all applicable customs, import, export, tax, and other governmental requirements relating to their Transactions and Parcels. Any customs duties, import taxes, VAT, sales taxes, processing fees, fines, penalties, or other governmental charges imposed in connection with a Parcel or Transaction are the responsibility of the Participant to whom they are legally imposed.
To the maximum extent permitted by applicable law, Participants agree to release and hold harmless Piligrim Port and Piligrim Delivery Inc. from claims, liabilities, penalties, costs, or expenses arising from a Participant’s failure to comply with applicable customs, import, export, tax, or other legal requirements.
(c) DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PILIGRIM PORT AND PILIGRIM DELIVERY INC. PROVIDE THE WEBSITE, APPLICATIONS, CONTENT, AND SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
PILIGRIM PORT DOES NOT WARRANT THAT THE WEBSITE, APPLICATIONS, CONTENT, OR SERVICES WILL MEET YOUR SPECIFIC NEEDS OR REQUIREMENTS, BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OPERATE WITHOUT INTERRUPTION OR ERROR, OR BE SECURE, ACCURATE, COMPLETE, RELIABLE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
PILIGRIM PORT DOES NOT GUARANTEE THE QUALITY, SAFETY, LEGALITY, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR TRUTHFULNESS OF ANY REQUESTS, TRIPS, PARTICIPANT PROFILES, PARCEL INFORMATION, COMMUNICATIONS, OR OTHER CONTENT PROVIDED BY PARTICIPANTS OR THIRD PARTIES.
PILIGRIM PORT DOES NOT GUARANTEE THAT ANY TRANSACTION WILL BE COMPLETED, THAT A PARTICIPANT WILL PERFORM THEIR OBLIGATIONS, THAT A PARCEL WILL ARRIVE AT THE DESTINATION, OR THAT A PARTICIPANT WILL RECEIVE ANY AGREED PAYMENT OR OTHER COMPENSATION FROM ANOTHER PARTICIPANT.
13. Limitation of Liability
The limitations of liability and allocation of risk set forth in these Terms are fundamental elements of the agreement between you and Pilgrim Port and apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, you assume all risks associated with your use of the Website, Applications, and Services. Pilgrim Port and Piligrim Delivery Inc., together with their respective directors, officers, employees, agents, contractors, service providers, licensors, and other parties involved in the operation or provision of the Website, Applications, or Services, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Website, Applications, or Services.
Such damages include, without limitation, loss of profits, loss of revenue, loss of data, loss of business opportunities, loss of reputation or goodwill, service interruptions, computer or device damage, system failures, costs of substitute products or services, personal injury, emotional distress, or any other losses arising out of or relating to the Website, Applications, Services, these Terms, or any Transaction between Participants.
Without limiting the foregoing, Pilgrim Port and Piligrim Delivery Inc. shall not be liable for any loss, damage, claim, liability, cost, or expense arising from or relating to:
(a) any act, omission, conduct, statement, representation, or failure to perform by any Participant;
(b) any communication, interaction, meeting, or Transaction between Participants;
(c) the loss, theft, destruction, delay, misplacement, or damage of any Parcel or other property;
(d) the failure of a Participant to deliver, receive, accept, return, or otherwise properly handle a Parcel;
(e) any failure, cancellation, delay, or change relating to a Trip, Request, Destination, or Delivery Date;
(f) any payment, compensation, Connection Fee, refund, or other financial arrangement between Piligrim Port and a Participant or between Participants;
(g) customs duties, taxes, import or export requirements, fines, penalties, seizure, confiscation, or other governmental actions relating to a Parcel or Transaction;
(h) inaccurate, incomplete, misleading, fraudulent, unlawful, or otherwise unreliable information or Content provided by Participants or third parties;
(i) unauthorized access to, alteration of, or disclosure of your account or information resulting from circumstances beyond Piligrim Port’s reasonable control; or
(j) any interruption, malfunction, error, delay, security incident, technical failure, or unavailability of the Website, Applications, Services, or third-party services used in connection with them.
These limitations apply regardless of the legal theory on which a claim is based, including contract, warranty, tort, negligence, gross negligence, strict liability, product liability, statute, or any other legal theory, even if Piligrim Port or Piligrim Delivery Inc. has been advised of the possibility of such damages, and even if any limited remedy provided under these Terms fails of its essential purpose.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, your sole and exclusive remedy for any dissatisfaction with the Website, Applications, or Services is to stop using them. Your sole and exclusive remedy for any dispute arising from or relating to a Transaction between Participants is against the Participant or Participants who are directly involved in that Transaction and not against Pilgrim Port or Piligrim Delivery Inc., except to the extent a claim against Pilgrim Port or Piligrim Delivery Inc. cannot lawfully be excluded or limited.
14. Release of Liability
You expressly waive any applicable rights or protections that may otherwise limit the scope of this release with respect to claims that you do not know or suspect to exist at the time of agreeing to this release, to the extent such waiver is permitted by applicable law.
If you have a dispute with one or more Participants, whether or not such dispute arises from or relates to a Transaction, you hereby release and hold harmless Piligrim Port and Piligrim Delivery Inc., together with their respective affiliates, subsidiaries, directors, officers, employees, agents, contractors, and service providers, from any and all claims, demands, liabilities, damages, losses, costs, and expenses of every kind and nature, whether known or unknown, arising out of or relating to such dispute, to the maximum extent permitted by applicable law.
15. General Provisions
(a) Indemnification and Release
You agree to indemnify, defend, and hold harmless Pilgrim Port and Piligrim Delivery Inc., together with their respective directors, officers, employees, agents, contractors, service providers, affiliates, and licensors, from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable legal and accounting fees, arising out of or relating to:
(i) your access to or use of the Website, Applications, Content, or Services, or your violation of these Terms;
(ii) any User Content you submit, post, transmit, or otherwise make available through the Website, Applications, or Services;
(iii) your interaction, communication, meeting, or Transaction with any Participant or other user;
(iv) any Parcel, Request, Trip, or delivery arrangement created, accepted, or participated in by you; or
(v) your violation of any applicable law, regulation, customs requirement, tax obligation, or third-party right.
To the maximum extent permitted by applicable law, you further release Pilgrim Port and Piligrim Delivery Inc. from claims arising from disputes or Transactions between Participants, including claims relating to the conduct, acts, omissions, representations, or failure to perform of another Participant. Nothing in this Section is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
(b) Entire Agreement
These Terms, together with any policies or additional terms expressly incorporated by reference herein, constitute the entire and exclusive agreement between you and Piligrim Port regarding your access to and use of the Website, Applications, Content, and Services.
These Terms supersede all prior or contemporaneous oral or written agreements, representations, communications, or understandings between you and Piligrim Port concerning the Website, Applications, Content, Services, and your use thereof.
(c) Assignment
You may not assign, transfer, delegate, or otherwise transfer your rights or obligations under these Terms, whether voluntarily, by operation of law, or otherwise, without the prior written consent of Pilgrim Port. Any attempted assignment or transfer in violation of this Section shall be null and void.
Pilgrim Port may assign, transfer, or delegate these Terms, in whole or in part, without your consent, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of all or substantially all of its business or assets.
Subject to the foregoing, these Terms shall be binding upon and benefit the parties and their respective successors and permitted assigns.
(d) Notices
Any notice or communication permitted or required under these Terms may be provided electronically by Pilgrim Port, including:
(i) by email to the email address associated with your Pilgrim Port Account; or
(ii) by posting the notice on the Website or through the Applications.
You are responsible for maintaining an accurate and current email address associated with your account.
A notice sent by email shall be deemed received when sent, unless Piligrim Port receives a notice that the email was not successfully delivered. A notice posted on the Website or Applications shall be deemed effective when posted.
(e) Waiver and Severability
The failure of Pilgrim Port to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision or prevent Piligrim Port from enforcing it at a later time.
Any waiver of a right or provision under these Terms must be made in writing by an authorized representative of Pilgrim Port.
If any provision of these Terms is determined by an arbitrator or court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified or enforced to the maximum extent permitted by applicable law, and the remaining provisions of these Terms shall remain in full force and effect.
(f) Governing Law, Jurisdiction, and Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles.
To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, Applications, Content, Services, or the relationship between you and Piligrim Port shall be resolved in accordance with the dispute resolution procedures set forth in these Terms.
Where arbitration is applicable under these Terms, the dispute shall be submitted to final and binding arbitration in Ontario, Canada, in accordance with the Arbitration Act, 1991 (Ontario) and any applicable rules of the arbitration tribunal or arbitrator. The Ontario Arbitration Act, 1991 expressly provides for arbitration agreements and governs arbitrations conducted under such agreements in Ontario.
The arbitration shall take place in Ontario unless the parties agree otherwise.
Nothing in this Section prevents either party from seeking any remedy or relief that cannot lawfully be required to be resolved through arbitration, including any remedy that applicable law requires to remain available through a court of competent jurisdiction.
16. Definitions
The following words and phrases shall have the following meanings for the purposes of these Terms:
“Applications” means the mobile applications operated by Piligrim Delivery Inc. under the Piligrim Port brand through which Users may access and interact with the Services.
“Collective Content” means User Content and Pilgrim Port Content.
“Content” means any text, graphics, images, photographs, music, software, audio, video, information, data, or other materials made available through the Website, Applications, or Services.
“Piligrim Port Content” means all Content provided, created, owned, or made available by Pilgrim Port through the Website, Applications, or Services, including Content licensed from third parties, but excluding User Content.
“Participant” means a User who has completed the registration process and created a Piligrim Port Account and who may use the Services to create, respond to, or participate in Requests, Trips, or Transactions.
“User Content” means any Content that a User or Participant posts, uploads, publishes, submits, transmits, or otherwise makes available through the Website, Applications, or Services.
“Transaction” means an arrangement or agreement entered into directly between Participants concerning the transportation or delivery of a Parcel, whether provided free of charge or for an amount agreed between the Participants. Piligrim Port is not a party to any Transaction between Participants.
“Connection Fee” means any fee charged by Pilgrim Port to a Participant for a successful connection or other platform service, as disclosed to the Participant before the fee is incurred. A Connection Fee is separate from any payment or compensation agreed directly between Participants.

This Privacy Policy describes how Piligrim Delivery Inc., operating under the Pilgrim Port brand (“Piligrim Port,” “we,” “us,” or “our”), collects, uses, stores, discloses, and otherwise processes personal information in connection with the Website, Applications, and Services.
This Privacy Policy applies to information collected through the Piligrim Port Website, Applications, and related Services, as well as information you provide to us directly.
By using the Website, Applications, or Services, you acknowledge that you have read and understood this Privacy Policy. Where consent is required by applicable law, we will obtain your consent before collecting, using, or disclosing your personal information for the applicable purpose.
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, Services, or applicable legal requirements. - communications with other Participants and Pilgrim Port;
- information provided through Google or Apple authentication; and

We do not require you to provide credit card or bank account information merely to browse the Website or Applications.

Account deletion does not necessarily require the immediate deletion of all information associated with the account where we are legally required or permitted to retain such information.
